We would like to remind you that only until the end of January can energy producers in small RES installations submit semi-annual reports on their operations, as referred to in Article 9 (1) (7) of the Law on Renewable Energy Sources. For RES installations that are not cogeneration units, the report must be submitted to the appropriate field branch of the ERO. It is important to submit a separate report for each installation. Please note that the date of fulfillment of the obligation is determined by the date of receipt at the Energy Regulatory Office.
According to the RES Act, each generator registered in the MIOZE registry must submit a report on its activities, according to the template published by the Energy Regulatory Office(https://bip.ure.gov.pl/bip/rejestry-i-bazy/wytworcy-energii-w-male/2138,Rejestr-wytworcow-energii-w-malej-instalacji.html). The obligation also extends to those generators who have been registered in the MIOZE in a given six-month period, but have not yet started their electricity generation activities.
Failure to comply with the reporting obligation by the deadline entails administrative liability and the risk that the President of the Energy Regulatory Authority will impose a fine of PLN 1,000. (Article 168(11) of the Renewable Energy Sources Act).
Violation of the obligation may also be relevant for those generators who plan to start the business of generating energy from RES installations with a capacity greater than 1 MW. The ERO President may negatively assess such a generator’s fulfillment of the prerequisite of providing a guarantee of proper performance of regulated activities (Article 33(3d) of the Energy Law) and refuse to grant a generation license (WEE) on this basis.
