Legal Advisor and Managing Partner at Raczyński Skalski & Partners Legal Advisors Attorneys Sp.p. based in Warsaw (www.rsplegal.pl). Expert in the field of law regulating the activities of entities in the financial sector, including payment services, banking, and fintech. He has many years of experience in providing legal advice to financial institutions (including the largest entities in the financial intermediation sector, loan companies, branches of credit institutions, and payment institutions) as well as legal advice on commercial company law (establishment and transformation, corporate disputes, including corporate disputes of public companies) and start-up investments. In 2023, he was awarded the title of “Leader” in the Banking and Financial Law category of the prestigious ranking of the Rzeczpospolita daily newspaper and has since been continuously included among the people distinguished in this category by this prestigious ranking. He speaks English.

 

Selected projects completed in recent years by the Law Firm team led by attorney Maciej Raczyński include:

  1. One of the first DORA audits in the country, carried out for one of the largest and most recognizable companies in Poland;
  2. Audit and comprehensive implementation of DORA in one of the companies belonging to one of the largest banking groups in the world;
  3. Preparation of documentation for the implementation of DORA for several obligated entities (mainly small payment institutions, but also domestic payment institutions);
  4. Representing an ICT provider in negotiations with the largest insurance company regarding compliance with DORA requirements.
  5. Compliance audit of the compliance of business activities with the requirements of regulations governing credit and insurance intermediation for one of the largest credit intermediaries (February 2025).
  6. Obtaining a license for a client from the financial industry to operate as a so-called national payment institution;
  7. Memorandum on legal requirements and possibilities of entering the Polish market by a crowdlending platform from Lithuania;
  8. Legal advice for two of the four largest online currency exchange offices in Poland with the status of small payment institutions (comprehensive – from regulations and agreements to claims, lawsuits, and court cases). Representation of these entities also in proceedings for the issuance of a license to operate as a domestic payment institution;
  9. Legal advice for the country’s largest lending institutions (DORA, AML, and ongoing regulatory advice, including in proceedings before the Polish Financial Supervision Authority);
  10. Legal advice, including drafting a memorandum for an EU-based entity regarding its entry into the Polish market (payment services);
  11. Legal advice for entities in the field of crypto-assets on obtaining a MICA license in proceedings before the Polish Financial Supervision Authority (KNF);
  12. Representation of supervised entities in inspection proceedings conducted by the Polish Financial Supervision Authority (KNF) regarding the implementation of anti-money laundering and counter-terrorist financing (AML/CFT) obligations.

  3. 4th and 5th workshops for the FinTech sector (together with the Association of Financial Companies) bringing together management and lawyers from the largest companies on the financial market to hold practical discussions on legislative changes in the area of FinTech and banking;
  4. Participation in a consultation conference organized by the Ministry of Finance in connection with the draft amendments to the Act on the Crypto-Asset Market (the so-called Lex Cinkciarz) – as the legal representative of online currency exchange offices. Development of an original concept of legal changes aimed at regulating the activities of online currency exchange offices in Poland (the concept of the so-called currency exchange account);
  5. Webinar for the Association of Financial Companies “DORA – what do we know after January 17, 2025, and what challenges do we face?”;
  6. Webinar for the Association of Financial Companies: “DORA – how to implement it on time and do it right?”
