“Part of the provisions of the just-consulted draft Law on Renewable Energy Sources (Journal of Laws 2023, item 1436, as amended) concerns prosumers. According to the justification, the change in billing rules is expected to increase the profitability of investments. A return to the net-metering system most favorable to prosumers, which we said goodbye to in 2022, is not there, but no one expected it either. The basic difference between net-metering and net-billing is that in the former, the energy given to the grid has the same value as the energy received. In the latter system, on the other hand, the prosumer gives energy back to the operator at whatever price is on the market at the time, and when he needs to power himself, he must also pay the market price for it. The problem is that the prosumer puts the most energy into the grid during the hours when there is the most sunshine, and at that time the hourly rates for energy are the lowest. Increasingly, even negative, In turn, he takes it when prices are highest. Hence there have been calls to make the current net-billing system, more cost-effective.

– The most beneficial change for the prosumer that the draft includes is a modification of the net-billing mechanism by increasing the value of the deposit. The deposit is the energy discharged to the grid and not used by the prosumer. Its value, according to the draft, is to be adjusted by a factor of 1.23. This is a significant change, because the value of the deposit will increase by one-fifth. As a result, the difference between the market price of energy for the prosumer and the offered rate from the operator’s tariff will decrease. The prosumer will have 12 months to use the deposit.
